Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BizTap website, dashboard, APIs, and related services (collectively, the "Service") operated by the developer and operator of BizTap("we", "us", or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BizTap is a software platform that helps businesses manage WhatsApp messaging, customer contacts, orders, appointments, and related workflows. We do not provide WhatsApp, mobile network, or payment processing services ourselves — those are provided by third parties (for example Meta/WhatsApp, your mobile carrier, PayFast, or other gateways you connect).

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Your responsibilities

  • You are solely responsible for how you use the Service, the messages you send, and compliance with applicable laws (including privacy, marketing, consumer protection, and telecommunications rules in your country).
  • You must obtain proper consent before messaging customers (for example via opt-in forms, QR codes, or other lawful methods). You are responsible for honouring unsubscribe requests.
  • You must comply with WhatsApp's Business Policy, Commerce Policy, and Terms of Service. We are not affiliated with Meta or WhatsApp and do not control their policies or enforcement actions.
  • You must keep your login credentials secure and ensure information you provide is accurate and up to date.

4. Acceptable use

You may not use the Service to:

  • Send spam, bulk unsolicited messages, or unlawful marketing.
  • Harass, defraud, impersonate, or harm others.
  • Upload malware, attempt unauthorised access, or interfere with the Service.
  • Violate intellectual property or privacy rights of any person.
  • Use the Service for any illegal purpose or in any way that could expose us to liability.

We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Service or other users.

5. Third-party services

The Service integrates with or relies on third-party products (including WhatsApp, Supabase, hosting providers, payment gateways, and maps). Your use of those services is governed by their own terms and policies. We are not responsible for outages, policy changes, account bans, fees, or actions taken by third parties.

6. Fees and trials

Pricing, trial periods, and billing terms are as shown on the website or agreed with you separately. Unless stated otherwise, fees are non-refundable. We may change pricing with reasonable notice where required.

7. Disclaimer — use at your own risk

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY.

You acknowledge and agree that you use the Service entirely at your own risk. We do not guarantee that the Service will be error-free, secure, available at all times, or suitable for your particular business needs. You are solely responsible for evaluating whether the Service is appropriate for you and for any decisions or actions you take based on it.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR DEVELOPERS, OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR CUSTOMERS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) one hundred South African Rand (ZAR 100).

9. Release and no legal claims against the developer

To the maximum extent permitted by applicable law, you hereby release, discharge, and hold harmless the developer, operator, and all related parties of BizTap from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including legal fees) of any kind arising out of or in any way connected with:

  • Your access to or use of the Service;
  • Messages you send or receive through the Service;
  • Your relationship with your customers, staff, or third parties;
  • Actions or decisions by WhatsApp, Meta, payment providers, or other third parties;
  • Loss of data, account suspension, or business interruption.

You agree that you will not bring or participate in any legal action, claim, or proceeding of any kind against the developer or operator of BizTap in connection with the Service, except where such waiver is prohibited by law and cannot be excluded by agreement.

10. Indemnification

You agree to indemnify, defend, and hold harmless us and our developers and operators from any third-party claims, fines, penalties, or expenses (including reasonable legal fees) arising from your use of the Service, your content or messages, your violation of these Terms, or your violation of any law or third-party rights.

11. Data and account termination

You may stop using the Service at any time. We may suspend or delete accounts that violate these Terms, remain inactive, or where required for security or legal reasons. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including disclaimers, limitation of liability, indemnity, and dispute terms) will survive termination.

12. Changes to these Terms

We may update these Terms from time to time. The "Effective date" at the top will change when we do. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. Subject to mandatory consumer protections that cannot be waived, you agree that courts in South Africa shall have exclusive jurisdiction over disputes relating to these Terms or the Service.

BizTap is provided as-is. You use it at your own risk. You are responsible for lawful messaging and customer consent. We are not liable for third-party services like WhatsApp. To the extent allowed by law, you release the developer from claims related to your use of the platform.
